Personal data processing policy

Introduction

The personal data processing policy hereof (hereinafter – “Policy”) provides for transparency of processing of the personal data (hereinafter – “Data”) of the job seekers (hereinafter - your/you) by “SOCAR Georgia Petroleum” LLC according to and within the scope of the procedure prescribed by the applicable legislation of Georgia, for the purpose of your employment and further for performance of labor and contractual relations.

SOCAR processes your data in accordance with the Law of Georgia “On Personal Data Protection”, with specific, clearly defined purposes and on the grounds defined by the above Law, and the company carries out the candidate selection process in accordance with the requirements of the Law of Georgia “On the Elimination of All Forms of Discrimination” and the principles of equal treatment of persons and excludes discrimination against persons on any grounds.

While processing your data, the requirements prescribed by the Law of Georgia “On Personal Data Protection” must be observed.

We protect your data as much as possible and have implemented proper organizational and technical security measures.

SOCAR employs a personal data protection officer who assists us to ensure a high standard of data protection at SOCAR. The personal data protection officer is the main contact person for the data subjects.

The terms used in the Policy shall have the meaning defined by the Law of Georgia “On Personal Data Protection”.

Data we process

We process, as well as collect and store the personal data provided by you when you fill in the fields for current vacancies posted on the website. Such data are:

First name
Last name
E-mail address;
Date of birth;
Phone number;
CV (resume), which may include (but is not limited to): photo, gender, citizenship, identity card/passport information, registration address, residential address, educational and qualification certificates or/and information and details on such document, reference letters, your vehicle registration number, etc.

In addition to the personal data listed above, SOCAR may process your other personal data, which is defined by the applicable legislation of Georgia (including the Organic Law of Georgia – “Labor Code of Georgia”) or/and is necessary to make a decision on employment, taking the needs of organizational regulation into account.

Purpose of data processing

We will not be able to assess your suitability for appointment to the current or/and future vacant position unless you provide us your data. Therefore, we process your data for the purpose of:

consideration of the application;
determination of suitability of your candidacy for a vacant position;
making a decision about employment.

Basis of data processing

Your data is processed according to the relevant legal grounds defined by the Law of Georgia “On Personal Data Protection”. In particular, the grounds for processing of personal data specified in this Policy is the important legitimate interest of SOCAR (the Article 5(1)(i) of the Law of Georgia “On Personal Data Protection”).

According to the Article 6(1)(h) of the Law of Georgia “On Personal Data Protection”, SOCAR is authorized to process special category data of a person, if processing of such data is necessary due to the nature of labor obligations and relations, inter alia, for making a decision on employment or assessment of the labor skills of a candidate.

Data storage and retention period

Personal data and CV (resume) provided by you shall be stored for the period of 1 (one) year after the decision on appointmet of a suitable candidate for the existing vacant position is made.

“SOCAR Georgia Petroleum” LLC may keep your personal data and CV (resume) for the period of 1 (one) year, in order to review your candidacy for a future vacant position, to determine suitability and to make a decision on employment.

If you agree that we keep your data and consider it in relation to future vacant positions, please write to us about this in the additional field – “Leave us a letter”. The notification must contain information on whether you agree to have your personal data and resume reviewed by SOCAR for the purpose of appointing you to another vacant position within 1 (one) year. Otherwise, your candidacy will be considered only for the existing vacancy.

In accordance with the Law of Georgia “On Personal Data Protection”, you have the right to:

request confirmation of whether your personal data is being processed, indicating the basis of such processing, the purpose and the retention period;
learn about the personal data collected about you;
request correction, update or/and completion of erroneous, inaccurate or/and incomplete data;
receive copies of personal data collected about you (if any);
request blocking of personal data retained by us about you (if any);
request withdrawal of consent you have given;
in addition, realization of other rights guaranteed by the Chapter 3 of the Law of Georgia “On Personal Data Protection”.

You are guaranteed to have unlimited access to the personal data protection officer of SOCAR, you can contact for consultation and additional information. Information about the personal data protection officer is posted on the website of SOCAR and is also indicated at the end of the Policy hereof.

Limitation of rights

In accordance with the Law of Georgia “On Personal Data Protection”, the rights of the data subject may be limited if this is directly provided for by the applicable legislation of Georgia, does not violate fundamental human rights and freedoms, is a necessary and proportionate measure in a democratic society, and the exercise of these rights may pose a threat to:

the interests of state security, information security and cyber security or/and defense;
public safety interests;
crime prevention, crime investigation, criminal prosecution, administration of justice, execution of imprisonment and depreviation of freedom, execution of non-custodial sentences and probation, operative and investigative activities;
interests related to financial or economic (including monetary, budgetary and tax), public health and social protection issues important for the country;
detection of violations of professional, including regulated profession, ethics norms by the data subject and assigning responsibility to him/her;
the rights and freedoms of the data subject or/and other persons, including freedom of expression;
protection of state, commercial, professional and other types of secrets stipulated by the Law;
substantiating a legal claim or objection.

The measure provided for restriction of your right as a data subject may be applied only to the extent necessary to achieve the purpose of restriction. When there are grounds for restriction of the right, the decision of SOCAR shall be communicated to the data subject in such a manner that the purpose of restriction of the right is not infringed.

Security measures

We provide all appropriate organizational and technical measures for protection of your personal data, which are required by the Law of Georgia “On Personal Data Protection” and regulatory legal acts.

We take necessary and sufficient organizational and technical measures in order to protect your information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions of the third parties. Despite of implementation of the above-mentioned organizational and technical measures, there is a risk of illegal processing of your personal data due to cybercriminals and other criminal activities. SOCAR cannot be held liable for such criminal acts.
